The Financial Conduct Authority (FCA) wasted no time in taking action as soon as the new crypto marketing regime came into effect. On the first day, they issued a total of 146 alerts to warn the public and businesses about illegal promotions in the crypto sector. The UK is actively seeking to attract crypto companies to its shores, but strict regulations must be adhered to. To assist consumers, the FCA has created a “Warning List” that individuals should check before making any crypto investments. This list will help them understand if a firm’s promotions may be in violation of the law and make better-informed decisions regarding their investments. The FCA will also update the list over time and adopt a risk-based approach, adding high-risk companies first and others who are not complying with the regulations or engaging positively with the regulator.
In order for crypto companies to promote their offerings, the FCA has outlined four possible routes to compliance. They include an authorized person communicating the promotion, an authorized person approving the promotion, a crypto firm registered under the Money Laundering Regulations (MLR) communicating the promotion, or the promotion complying with the conditions of an exemption in the Financial Promotion Order. The FCA has been warning crypto companies about these changes since February and companies were given a deadline to prepare their compliance strategies. The FCA emphasizes that they will take strong action to remove illegal content and protect consumers in cases of non-compliance.
