In a development that poses a challenge for Sam Bankman-Fried, the founder of FTX cryptocurrency exchange, a US judge has placed restrictions on his ability to present expert witnesses at his criminal fraud trial. Bankman-Fried had originally hoped to call upon seven experts who could testify on topics related to cryptocurrency markets and English contracts in an attempt to sway the jury and secure his acquittal on charges of stealing billions of dollars in FTX customer funds to cover losses at his Alameda Research hedge fund.
US District Judge Lewis Kaplan has issued a written order that excludes three of the proposed expert witnesses, considering their testimony either irrelevant or potentially confusing for the jury. This decision was made after the US Department of Justice filed a motion in late August to exclude all witnesses suggested by Bankman-Fried. Among the experts barred from testifying was Peter Vinella, a consultant who was expected to discuss “FTX’s use of widely-accepted practices in the financial services industry,” which Judge Kaplan deemed irrelevant to the case. Additionally, Bankman-Fried was not allowed to call English barrister Lawrence Akka to testify about FTX’s terms of service, as the judge believed only a judge could instruct the jury on matters of law.
Judge Kaplan’s decision also rejected the defense’s requests for testimony on FTX’s financials, software, and document metadata from consultants Thomas Bishop and Joseph Pimbley, as well as data analytics specialist Brian Kim. The court cited Rule 16, which requires the government to reveal specific evidence it intends to use throughout the trial, as the basis for rejecting their potential testimony. Bankman-Fried may file a request to allow certain witnesses to testify if his lawyers believe they can refute testimony from government witnesses, but the government may oppose the filing.
